Partner Program Terms

When you join the Burst Commerce Partner Program (“Program”), you are agreeing to these latest terms (“Agreement”). Violation of this Agreement may, at our discretion, result in us terminating your participation in the Program.

We may update this Agreement at any time. If we make significant changes, we will refresh the date at the top of this document. We reserve the right to edit or change the terms of the Program at any time, with or without notice.

Definitions

“Company,” “we,” “our,” or “us” refers to Burst Commerce.

“Partner” or “you” refers to the individual or entity participating in the Program.

“Services” refers to our Shopify apps, including Flair and Best Seller Insights.

“Qualified Referral” refers to any new customer who subscribes to a paid plan of Flair or Best Seller Insights through your unique referral link and remains an active, paying customer.

“Commission” refers to the 20% recurring payment you earn for the life of a Qualified Referral’s subscription, subject to the terms below.

Program Overview

The Program allows approved Partners to promote our Services, Flair and Best Seller Insights, to drive sales. Eligible Partners include Shopify agencies, Shopify partners, Shopify app developers, influencers, and affiliates. By participating, you agree to market our Services ethically and in accordance with this Agreement.

Eligibility and Enrollment

To join the Program, you must apply through our designated process and be approved by us. We reserve the right to reject any application for any reason. Your partnership activates only after you have 3 or more active Qualified Referrals.

Partner Responsibilities

You agree to:

  • Promote our apps, Flair and Best Seller Insights, to drive more sales
  • Comply with all applicable laws and Shopify’s terms.
  • Disclose your partnership with us as required by law (e.g., FTC guidelines).
  • Maintain the security of your account.

You may not:

  • Run any paid ads using the Burst Commerce, Flair, or Best Seller Insights brand names.
  • Use the Services or Program for any purpose outlined in our Restricted Purposes (see Terms of Service).
  • Misrepresent our Services or make false claims about them.

Company Responsibilities

We will:

  • Provide you with a dashboard to track sales and receive payments.
  • Pay Commissions as outlined below.
  • Supply marketing materials for your use, subject to our Intellectual Property terms.

Compensation

  • Commission Rate: You earn a 20% commission on the subscription fees paid by each Qualified Referral for the life of their active subscription.
  • New Customers Only: Commissions apply only to new customers who have not previously subscribed to Flair or Best Seller Insights.
  • Activation Threshold: Your partnership and Commission payments activate only after you achieve 3 or more active Qualified Referrals.
  • Payment Terms: Commissions are paid monthly via PayPal, with a minimum payout threshold of $50. If your earned Commissions fall below $50 in a given month, they will roll over to the next month until the threshold is met.
  • Tracking: We track Qualified Referrals via your unique referral link. You may also submit referrals manually with approval. You may access performance data through a dashboard we provide.

Term and Termination

This Agreement begins upon your approval into the Program and continues until terminated. Either party may terminate this Agreement with 30 days’ written notice. We reserve the right to suspend or terminate your participation immediately, without notice, for any reason, including violations of this Agreement or our Terms of Service. Upon termination, you will receive any earned Commissions for Qualified Referrals up to the termination date, subject to the $50 threshold.

Intellectual Property

We own all rights to the Burst Commerce, Flair, and Best Seller Insights brands, logos, and Services. You are granted a limited, revocable license to use provided marketing materials solely for the Program. You may not reproduce, modify, or exploit our intellectual property without express written permission.

Confidentiality

You agree to keep confidential any sensitive information we share with you (e.g., customer data, business strategies) and use it only for Program purposes.

Marketing and Compliance

You must promote our Services in a manner consistent with this Agreement and our Terms of Service. Prohibited activities include spamming, misleading advertising, or any Restricted Purposes outlined in our Terms of Service.

Liability

You agree that we are not liable for any damages arising from your participation in the Program, including your inability to earn Commissions or third-party actions. You are solely responsible for your conduct under this Agreement.

Governing Law

This Agreement is governed by the laws of North Carolina, USA.

Miscellaneous

  • This Agreement is the entire understanding between us regarding the Program and supersedes any prior discussions.
  • If any part of this Agreement is invalid, the rest remains enforceable.
  • Verbal, physical, written, or other abuse of our employees will result in immediate termination of your participation.
